“So, no matter how innocent those seven civilian citizens’ testimony may be, does that count for less than an accusation made verbally by two police officers?

The concept of ‘the right to a hearing’ means that people are heard and given an opportunity to speak. But if what they say is not genuinely considered, then merely hearing the other side is no different from a one-sided hearing.

In the Var Bahadur case, the police even produced a letter as evidence, claiming it had been written by the accused to a terrorist organization. However, it was later established in the appellate court that the handwriting was not that of the accused, and the defendant was acquitted.

No one is more skilled than the police at fabricating and manipulating evidence.

In this case, the prosecution’s exhibits consist of:

(a) the complaint letter,

(b) the search and seizure record relating to the mosque,

(c) the prosecution sanction order,

(d) photographs of the accused,

(e) the accused’s statement,

and exhibits (f), (g), (h), and (i), which are documents related to the mosque.

Yet not a single one of these items demonstrates that the accused supported terrorism.

Zero evidence.

Is there any evidence that the accused transported dead or injured persons in an ambulance?

And even if they did transport them, does that amount to supporting terrorism?

Where has judicial discretion gone?

The armed organization involved has already reached a peace agreement with the military, yet ordinary civilians are arrested and imprisoned, while an unrelated mosque is confiscated. This is a dog’s judgment (a Burmese expression meaning an utterly unjust or disgraceful judgment).

Did the court comply with Paragraph 1091(1) of the Courts Manual, which states that where an exhibit was seized from a person other than the plaintiff or the accused, that person must be given an opportunity to be heard before an order is made regarding the management or disposal of the property?

The chairman of the mosque was never examined.
