The strongest legal challenge to the confiscation appears to be:<\/strong><\/p>\n\n\n\n

    \n
  1. Whether a public mosque can legally be treated as the private property of accused individuals.<\/li>\n\n\n\n
  2. Whether mosque trustees and community representatives were given an opportunity to be heard before confiscation.<\/li>\n\n\n\n
  3. Whether sufficient evidence linked the mosque itself to the alleged offences.<\/li>\n\n\n\n
  4. Whether confiscation of an entire place of worship was proportionate to the alleged conduct.<\/li>\n<\/ol>\n\n\n\n

    In July 2025, after the military council’s forces re-entered and attacked Naungcho town, which had been under the control of the Ta’ang National Liberation Army (TNLA), the military sealed off more than 20 properties on accusations of links to revolutionary groups. These included the town’s main mosque, as well as a guesthouse, gold shops, petrol stations, and civilian residences belonging to a Gurkha religious organization.<\/p>\n\n\n\n

    When the military first entered the town, it had sealed the mosque on the grounds that it had been renovated without permission. It has now brought terrorism-related charges and permanently confiscated it as state property.<\/p>\n\n\n\n

    Background<\/h2>\n\n\n\n

    Following the military council’s re-establishment of control over Naungcho Township in northern Shan State, authorities sealed the town’s Central Mosque, located in the central market quarter, during the third week of July 2025. The official justification reportedly cited unauthorized renovation works carried out on the building. Religious leaders and mosque trustees were also detained.<\/p>\n\n\n\n

    Although various explanations relating to land use and administrative regulations were later cited, local residents contend that the authorities accused certain individuals in the town of supporting resistance organizations, including the TNLA, DPLA and PDF groups. According to local accounts, a number of properties were subsequently targeted, including religious buildings, a four-storey Gurkha Dhammathala building located on religious land, and approximately twenty civilian homes.<\/p>\n\n\n\n

    While the case reportedly originated in 2025, the final court order was issued on 18 September 2026<\/strong>, when the mosque building was ordered confiscated as state property.<\/p>\n\n\n\n

    Legal Issues Raised by the Court Order<\/h2>\n\n\n\n

    According to the court order, the defendants were convicted under provisions of Myanmar’s Counter-Terrorism Law, including Sections 50(j) and 52(a). The judgment was reportedly issued by the Kyaukme District Court in Criminal Case No. 3\/2025 under Judge Kyaw Soe Naing.<\/p>\n\n\n\n

    The most controversial aspect of the judgment is the reported order confiscating the mosque itself as state property.<\/p>\n\n\n\n

    1. Confiscation of Property Not Owned by the Accused<\/h3>\n\n\n\n

    A fundamental principle of criminal confiscation is that property subject to seizure ordinarily must belong to the convicted person or have been demonstrably connected to the alleged offence.<\/p>\n\n\n\n

    A mosque, however, is generally not regarded as the private property of a single trustee, imam, administrator or worshipper. It is a religious institution donated for public religious use.<\/p>\n\n\n\n

    Under this principle, legal critics argue that even if an individual associated with a mosque is convicted of an offence, that fact alone does not automatically justify confiscation of an entire religious building used by the wider community.<\/p>\n\n\n\n

    The same logic would ordinarily apply to monasteries, churches, temples and other public religious institutions. If an individual resident, trustee or employee commits an offence, the law does not automatically extinguish the rights of an entire religious community.<\/p>\n\n\n\n

    Critics therefore argue that confiscating a mosque because of allegations or convictions involving specific individuals raises serious questions concerning ownership, proportionality and the rights of the broader religious community.<\/p>\n\n\n\n

    \n\n\n\n

    2. Denial of the Right to Be Heard<\/h3>\n\n\n\n

    Legal observers have also raised concerns regarding procedural fairness.<\/p>\n\n\n\n

    According to the argument advanced by local lawyers, where property belongs to persons other than the accused, those persons should ordinarily be given an opportunity to present objections before a confiscation order is made.<\/p>\n\n\n\n

    If mosque trustees, community representatives or other lawful custodians were not notified or afforded an opportunity to defend the interests of the mosque before confiscation, critics argue that such action would be inconsistent with fundamental principles of natural justice.<\/p>\n\n\n\n

    One of the most basic principles of justice is expressed in the rule:<\/p>\n\n\n\n

    “Hear the other side.”<\/strong><\/p>\n\n\n\n

    No person or community should be deprived of property rights without first having an opportunity to respond to allegations affecting those rights.<\/p>\n\n\n\n

    \n\n\n\n

    3. Lack of Evidentiary Nexus and Proportionality<\/h3>\n\n\n\n

    Another major question concerns whether sufficient evidence was presented linking the mosque building itself to any alleged criminal offence.<\/p>\n\n\n\n

    Critics argue that there must be a clear evidentiary connection between the alleged offence and the property being confiscated.<\/p>\n\n\n\n

    Even assuming criminal liability on the part of particular individuals, confiscating an entire place of worship used by a religious community may be viewed as disproportionate if the building itself was not proven to have been directly used for unlawful activity.<\/p>\n\n\n\n

    This issue engages both property rights and religious freedom concerns.<\/p>\n\n\n\n

    Myanmar’s Constitution contains provisions relating to freedom of religion and recognizes the existence and protection of major religious faiths practiced in the country. <\/p>\n\n\n\n

    \n\n\n\n

    Compliance Under Armed Control Is Not Automatically Collaboration<\/h2>\n\n\n\n

    A fundamental question arises whenever an armed organisation takes control of a town.<\/p>\n\n\n\n

    According to local accounts, many residents fled Naungcho as fighting intensified while armed groups occupied public buildings and administrative centres.<\/p>\n\n\n\n

    Under such circumstances, an important legal distinction must be maintained:<\/p>\n\n\n\n

    \n

    Compliance under duress is not the same as voluntary collaboration.<\/p>\n<\/blockquote>\n\n\n\n

    If armed personnel demand food, supplies, accommodation or other assistance, civilians may comply because refusal could place themselves or their families in danger.<\/p>\n\n\n\n

    A shopkeeper who hands over food after receiving threats cannot automatically be equated with someone who voluntarily joins an armed organisation, plans military operations or intentionally provides strategic support.<\/p>\n\n\n\n

    The same principle applies to religious figures, village administrators, civil servants and ordinary residents who remain in a town during armed occupation.<\/p>\n\n\n\n

    Their presence alone does not establish criminal liability.<\/p>\n\n\n\n

    Questions of coercion, freedom of choice, threats, intent and actual participation must be examined on an individual basis.<\/p>\n\n\n\n

    Justice requires evidence, individual responsibility and due process, not collective punishment.<\/p>\n\n\n\n

    \n\n\n\n

    Concerns Regarding the Court’s Reasoning<\/h2>\n\n\n\n

    Critics of the judgment argue that the court placed excessive reliance upon allegations and witness testimony without sufficiently examining whether independent evidence established criminal responsibility beyond reasonable doubt.<\/p>\n\n\n\n

    They further contend that longstanding criminal law principles require:<\/p>\n\n\n\n
